By accessing or using Motorbay Online's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Motorbay Online provides cloud-based garage management software that includes features such as vehicle bookings, MOT management, customer relationship management, job sheets, estimates, invoices, and VRM lookup services.

3. Account Registration

To use our services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised access

4. Subscription and Payment

Our services are provided on a subscription basis. By subscribing, you agree to:

• Pay the fees associated with your chosen plan
• Provide valid payment information and authorise recurring charges
• Accept that subscription fees are non-refundable except as required by law

We offer a 14-day free trial. No payment is required during the trial period. Your subscription will begin at the end of the trial unless you cancel.

5. Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

• Your access continues until the end of your current billing period
• No further charges will be made
• Your data will be retained for 30 days before deletion

6. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit malicious code or interfere with our systems
• Attempt to gain unauthorised access to our services or systems
• Use the service for any fraudulent or illegal purpose

7. Your Data

You retain all rights to the data you upload to our service. By using our service, you grant us a limited licence to store, process, and display your data solely to provide our services to you. We will not access, use, or share your data except as necessary to provide the service or as required by law.

8. Third-Party Services

Our service integrates with third-party services including DVLA for vehicle data lookup. Your use of these integrations is subject to the terms and conditions of those third parties. We are not responsible for the accuracy or availability of third-party data.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or emergency repairs. We will provide notice where reasonably possible.

10. Limitation of Liability

To the maximum extent permitted by law, Motorbay Online shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Motorbay Online from any claims, damages, or expenses arising from your use of the service or violation of these terms.

12. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
